There will be a Planning Commission meeting in and for the City of Albany, Stearns County, Minnesota, at 6:30 o’clock in the evening on Thursday, October 24, 2019, in the Council room at 400 Railroad Avenue for the said City for the following:

1. The public hearing will be held on a request by Catherine Wolf and Rachael Buttweiler, 21837 Trestle Ridge Road, Albany, MN, for a conditional use permit (Section 80.19, Subd. 2) to operate a child day-care in a Core Commercial (C1) District at 521 Railroad Avenue, the former Albany True Value building. 

Anyone wishing to comment will be heard at the public hearing and written comments may be forwarded to the office of the City Clerk/Administrator before the time of the public hearing.

ORDINANCE 2019-01

ALBANY SCHEDULE OF FEES AND CHARGES

AMENDMENT TO APPENDIX “A”

The City Council for the City of Albany, HEREBY ORDAINS effective January 1, 2020, Appendix A, Albany Schedule of Fees and Charges, miscellaneous administration charges, of the Albany City Code, shall be amended to read as follows:

30.19.1 Water Use fee:    

January 1, 2020   $3.84/thousand gallons

Said fee shall increase 4% per year effective January 1 of each year unless otherwise amended by the Council.

Water Meter fee:

January 1, 2020 $5.00/monthly

Billing Period is bi-monthly.

30.19.2 After 30 days, the past due or late fee shall be 10% of amount due.

30.19.5 Water Access/month:     

January 1, 2020   $16.56

Said fee shall increase 4% per year effective January 1 of each year unless otherwise amended by the Council.

30.19.6 Water Trunk fee: $1,220/acre

31.09.2 Sewer Trunk fee: $1,220/acre

31.11     Sewer Use fee (residential/commercial/institutional)     

January 1, 2020   $3.10/thousand gallons

Said fee shall increase 4% per year effective January 1 of each year unless otherwise amended by the Council.

Billing Period is bi-monthly.

Sewer Flat Charge/month:        

January 1, 2020   $6.90

Said fee shall increase 4% per year effective January 1 of each year unless otherwise amended by the Council.

Multi-family units will be charged a monthly flat charge for each unit.

Recreational vehicles/trailers- dump sites $150/year.

Schools, Churches, and motels-Set by City Administration subject to Council review based upon potential volume.)

32.26 Sewer Industrial Users

2020  

Flow Charge/1,000 gallons $0.75  

BOD Charge/pound $0.104  

SS Charge/pound $0.083   

Phosphorus Charge/pound $5.46

Sewer Flat Charge/month $6.90

Said fees shall increase 4% per year effective January 1 of each year unless otherwise amended by the Council.

Billing period is monthly.

32.31   Non-sewered water usage for the month of May and June shall be excluded from volume utilized to compute residential sewer service.

30.19.4   Minimum Billing Bi-monthly:  

o Residential 1,000 gallons 

o Commercial 6,600 gallons 

33.02.3 Storm Water Utility Base Rate: $4.00 Bi-monthly

33.02.4 After 30 days, the past due or late fee shall be 10% of amount due. 

This ordinance shall take effect following publication on January 1, 2020.

Ordinance 2017-02 is hereby rescinded to the extent that the provisions contained therein are inconsistent with the provisions of this Ordinance. 

This amendment to Appendix A, Albany Schedule of Fees and Charges, was approved by the majority of the City Council of the City of Albany on this 2nd day of October, 2019.

IN RE:  THE MATTER OF THE HAZARDOUS and NUISANCE PROPERTY LOCATED AT EVERGREEN HILLS MANUFACTURED HOME PARK, 17682 UPPER SPUNK LAKE RD., AVON, MINNESOTA.

ORDER FOR REPAIR OR REMOVAL OF HAZARDOUS AND NUISANCE PROPERTY AND STRUCTURES AND ABATEMENT ORDER OF THE STEARNS COUNTY BOARD OF COMMISSIONERS.

TO:  EVERGREEN HILLS MANUFACTURED HOME PARK (hereinafter referred to as “the subject property”,  and DANIEL PITZER, LINDA PITZER, AND JAMES PITZER (hereinafter referred to herein as “the LANDOWNERS”).

WHEREAS, the LANDOWNERS have accumulated and allowed the accumulation of refuse, garbage and other debris on the subject property, creating a public health, welfare, and safety hazard;

WHEREAS, the LANDOWNERS have allowed the growth of brush, grass, and weeds, resulting in the spread of noxious weeds and promoting rodent harborage, creating a public health, welfare, and safety hazard;

WHEREAS, the LANDOWNERS have allowed the storage of materials and appliances on the subject property, creating a public health, welfare, and safety hazard;

WHEREAS, the subject property contains a manufactured home (Lot 17 -18397 332nd Street) which has been partially demolished and disassembled, has been subject to weather over last winter, and which has not been cleaned up, and which presents a safety hazard and public nuisance;

WHEREAS, the subject property contains a manufactured home (Lot 31 – 33379 185th Avenue) which the LANDOWNERS have not maintained, is uninhabitable, dilapidated, damaged, unsanitary, and which presents a safety hazard and public nuisance;

WHEREAS, the subject property contains a manufactured home (Lot 34 – 33316 185th Avenue) which the LANDOWNERS have not maintained, is uninhabitable, dilapidated, damaged, unsanitary, and which presents a safety hazard and public nuisance;

WHEREAS, the manufactured homes at Lots 31 and 34 do not meet the rental ordinance requirements, and the LANDOWNERS have been provided with corrective measures which have not been made.  These two homes have been posted as uninhabitable.  The corrective measures reports are attached as EXHIBIT A, and are incorporated herein;

WHEREAS, efforts have been made by the Environmental Services Department to obtain voluntary compliance by the LANDOWNERS, who have failed to cooperate in addressing the hazardous conditions of the manufactured homes or razing and lawfully disposing of them; and have failed to address the unhealthy, unsafe, and hazardous condition of the subject property; and

AND, WHEREAS, the subject property constitutes hazardous buildings and hazardous property pursuant to Minnesota Statute §463.15;

IT IS THERFORE, HEREBY ORDERED:

That the LANDOWNERS shall have 30 days from receipt of lawful service of this Order to bring Evergreen Hills Manufactured Home Park into compliance with the law and follow the directives, which are attached as Exhibit A or demolish and lawfully remove the manufactured homes at Lots 31 and 34; remove the remains of the structure at Lot 17; and in which to otherwise address the refuse, garbage and other debris on the subject property, and the overgrowth of grass, brush, and weeds.

That if the LANDOWNERS fail to make the corrections specified above, and follow the directives as specified in the attached Exhibit A or demolish and remove the manufactured homes at Lots 31 and 34 within the next 30 days, then Stearns County Environmental Services Department shall abate the hazardous condition of the subject property and its’ structures, the cost of which shall be charged against the real estate.

That following the 30 day timeframe, the date the LANDOWNERS have received or have been lawfully served with this Order, Stearns County Environmental Services is authorized to seek enforcement of this Order in the Stearns County District Court by way of a motion for summary enforcement of the Order, unless an answer is filed within 20 days of the date of service, pursuant to Minn. Stat. §463.18; at which time the proceeding will be handled by the District Court in accordance with Minnesota Statute §463.20.

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Managers of the Sauk River Watershed District pursuant to Minnesota Statue 103D.605 will hold a hearing October 15th, 2019, at 6:30 p.m. at the Sauk River Watershed District office located at 524 Fourth Street South in Sauk Centre, Minnesota.  The purpose of the hearing is to consider and take comments on the 2019 Outdoor Heritage Fund “Sauk River Watershed Habitat Protection and Restoration” Lessard Sam’s Outdoor Heritage Fund Grant Project, project #354.

This project proposes to acquire lands in fee and permanent conservation easements and restore and enhance wildlife habitat in the Sauk River Watershed. This project will permanently protect, restore and enhance approximately 720 acres of high priority, critical habitat.  The project will also restore/enhance approximately 290 acres of wetlands and accompanying uplands. Properties selected will be strategically targeted using an innovative site prioritization model that maximizes conservation benefit and financial leverage. The total estimated cost of the project is $2,946,000 to be paid from a grant from the State of Minnesota under the Lessard Sam’s Outdoor Heritage Fund; with $440,000 to the Sauk River Watershed District, $590,000 to Pheasants Forever and $1,916,000 to the Minnesota Land Trust. These funds are provided by the Clean Water Land & Legacy Amendment. Additional funds, including in-kind contributions may come from, in addition to the organizations above, local Soil and Water Conservation Districts, The Nature Conservancy, US Fish and Wildlife Service, Department of Natural Resources, Ducks Unlimited, the State’s Clean Water Fund program, the State’s Clean Water Partnership program or other sources.
