Notice of Intent to Enact an Ordinance

Notice is hereby given that the Stearns County Board of Commissioners, in and for the County of Stearns, will conduct a public hearing to consider a rezoning request submitted by JITA Properties, LLC, Avon MN to rezone approximately 15.08 acres from the Agricultural 40 zoning district to the Residential 5 zoning district in accordance with =Section 4.10 of Stearns County Land Use and Zoning Ordinance #439.  The property under consideration is located in part of Government Lot 3, lying southerly and easterly of Timber Road in Section 31, Holding Township (126/30).  Property address is 38718 Timber Road, Avon.  Notice is further given of the County Board’s intent to enact Ordinance Number 574, if the request for rezoning is approved.  Copies of the rezoning application and Ordinance Number 574 are available for public review in the Stearns County Environmental Services Department located in Room 343, 705 Courthouse Square, St. Cloud, MN.

Notice is further given that the above hearing and ordinance enactment will be held on Tuesday, July 10, 2018 beginning at, or as soon as possible after, 9:10a.m. in the County Board Room of the Stearns County Administration Center, located at 705 Courthouse Square, St. Cloud, MN  56303.

NOTICE OF ?PUBLIC HEARING
A rezoning request has been received from H & L Partnership, 35536 County Road 10, Albany, MN (Parcel Number 01.00113.0005) to rezone from an A40 to R1. According to the Albany Township Zoning Map, this is an A40 zone. The existing lot is 61.31 acres. The proposed lot would be approximately 9.5 acres, based on ordinance requirements, for the lot with the existing buildings and the balance (approx.51.81 acres) being for an additional residence. According to Section 4.10 Zoning Ordinance Amendments, a public hearing must be held for any amendment to the Zoning Map.

A public hearing regarding the request for permit will be held by the Albany Planning Commission on Tuesday, July 10, 2018, beginning at 7:30 P.M. in the Albany City Council Chambers, 400 Railroad Ave, Albany MN. You may submit testimony by appearing at the above hearing or by submitting written testimony prior to the hearing date.
