SUMMONS

THIS SUMMONS IS DIRECTED TO: DEFENDANTS ABOVE-NAMED.

1. YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is attached to this Summons. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no Court File Number on this Summons.

2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this Summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiff’s Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint, you must say so in your Answer.

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If YOU DO NOT Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint.

5. LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about places where you can get legal assistance. Even if you cannot get legal help, you must still provide a written Answer to protect your rights or you may lose the case.

6. ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.

7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Stearns County, State of Minnesota, legally described as follows:

South Half Southwest Quarter (S 1⁄2 SW 1⁄4) and Southwest Quarter Southeast Quarter (SW 1⁄4 SE 1⁄4), Section 22, Township 122 North, Range 30 West, Stearns County, Minnesota.

The object of this action is: an order pursuant to the Minnesota Uniform Voidable Transaction Act, Minnesota Statutes §§ 513.41 et seq., avoiding certain transfers of the above- described real estate and permitting Plaintiff to levy upon and execute its judgment against the above-described real estate.

The undersigned hereby acknowledges that sanctions may be awarded pursuant to Minn. Stat. § 549.211.

-Notice of Public Hearing-

Notice is hereby given, pursuant to Minnesota Statute, Section 394.26, that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct a public hearing on Thursday, January 23, 2020, in Conference Room 121, Stearns County Service Center West, 3301 County Road 138, Waite Park, MN, beginning at 6:30 p.m.

Purpose of the hearing is to consider the granting or denial of variances from the Stearns County Land Use & Zoning Ordinance, Stearns County Subdivision Ordinance, Stearns County Sewage Treatment Ordinance, Stearns County Recreational Campground Ordinance, Stearns County Lodging Establishments Ordinance, Stearns County Childrens Camps Ordinance and the Stearns County Manufactured Home Parks Ordinance as follows:

Public Hearings:

1. To consider a request from Michael & Vicki Sadlowsky, Elk River, MN from Sections 5.1.2C(1) & 10.2.11A(1)(a) of Stearns County Land Use & Zoning Ordinance #439 to construct an addition onto a legal non-conforming accessory structure and a new accessory structure less than 100 feet from the Ordinary High Water Level (OHWL) of Big Birch Lake, classified a Recreational Development Lake.  Said Ordinance requires a structural setback of 100 feet from the OHWL of a Recreational Development Lake and does not allow for any additions or alterations to a non-conforming accessory structure unless the addition or alteration meets the minimum setback requirement.  Affected property:  Lot 1, Block 1 of Wood Castle Hills, Section 05, T126N, R32W, Millwood Township.  Property address:  30325 440th Street, Melrose, MN.

2. To consider an After the Fact request submitted by Timothy Haeg, Watab Incorporated, on behalf of Amy J. Grider Trust, Grey Eagle, MN from Section 6.2.1N(1) of Stearns County Subsurface Sewage Treatment Ordinance #422 to leave as constructed insufficiently sized maintenance holes on a septic tank that are not extended above final grade.  Said Ordinance requires a septic tank to have a minimum of two maintenance holes with a minimum diameter of 20 inches and extending through the tank cover above final grade.  Affected property:  Lot 10 & the Northwesterly 25 feet of Lot 9 of  Maplewood Terrace, Section 35, T127N, R33W, Melrose Township.  Property address:  33276 Birch Crest Road, Grey Eagle, MN.
