RIGHT-OF-WAY MANAGEMENT ORDINANCE

The Board of Supervisors for the Town of Melrose, Stearns County, Minnesota, now hereby ordains that on the 2nd day of May, 2019, the Melrose Township Board of Supervisors adopted the above Ordinance. Due to the lengthy content, a brief Summary follows:

An ordinance to administer and regulate the public right-of-way in the public interest, and to provide for the issuance and regulation of right-of-way permits, pursuant to the powers granted under Minnesota Statutes and Minnesota Rules.

Ordinance No. 2019-02 a “Right-Of-Way Management Ordinance” shall take effect and be in full force immediately following its adoption and upon publication. ORDINANCE REGULATING THE CONSTRUCTION AND MAINTENANCE OF DRIVEWAYS/CULVERTS WITHIN THE TOWNSHIP

The Board of Supervisors for the Town of Melrose, Stearns County, Minnesota, hereby ordains that on the 2nd day of May, 2019 the Melrose Township Board of Supervisors adopted the above Ordinance. Due to the lengthy content of the Ordinance, a brief Summary follows:

Section 1. Authority. Identifies the authorities used in preparation of said Ordinance.

Section 2. Purpose. Identifies the purpose of the Ordinance.

Section 3. Definitions. Clarifies language used in the Ordinance. 

Section 4. Permit Required. Identifies that a permit from the Township is required for constructing a driveway or field approach.

Section 5. Conditions of Permit. Identifies the conditions of the permit.

Section 6. Inspection of the work, escrow amount and fees. Provides for the inspection of the work and such escrow amounts and fees necessary to cover the costs of inspection and to ensure that the work is completed properly.

Section 7. Indemnification. Provides for the indemnification of the Township for any negligence on the part of the applicant.

Section 8. Violation. Identifies the consequences for violation(s) of this Ordinance.

Section 9. Separability. Validity of the Ordinance should a provision be declared invalid.

Section 10. Effective date. Identifies the effective date of Ordinance. 

Ordinance 2019-04, an “Ordinance Regulating the Construction and Maintenance of Driveways/Culverts within the Township” shall take effect and be in full force immediately following its adoption and upon publication. Section 6. Removal of Man-made Obstructions. Provides for the removal by the Township of obstructions placed within the Township’s road right-of-way.

Section 7. Abutting Property Owner. Provides that abutting property owner is presumed responsible for any obstructions placed within the Township’s road right-of-way.

Section 8. Separability. Validity of the Ordinance should a provision be declared invalid.

Section 9. Repealer. Repeals any provisions of other Township ordinances that conflict with Ordinance.

Section 10. Effective date. Identifies the effective date of Ordinance.

The Board of Supervisors for the Town of Melrose, Stearns County, Minnesota, hereby ordains that on the 2nd day of May, 2019 the Melrose Township Board of Supervisors adopted the above Ordinance. Due to the lengthy content of the Ordinance, a brief Summary follows:

Preamble. Identifies the authority and a clarification of the factors that come into play in decisions on how the Township roads are managed.

Definitions. Clarifies the language used in the Ordinance

Article 1. Township Road Standards and Specifications. Defines the requirements for new and existing roads need to be built to for acceptance by the Township.

Article 2. General Maintenance Policy. Provides a summary of how Township roads are maintained.

Article 3. Snow Plowing Policy. Provides a reference to the Township Snow Plowing Policy.

Article 4. Paving Policy. Provides a description of the process and considerations on the paving of township roads.

Article 5. Subdivision Road and Street Standards. Reserved for future use.

Article 6. Dedicated Road Acceptance Policy. Provides a description of the process for a road to be accepted by the Township.

Article 7. Approach and Driveway Policy. Provides a reference to the Township Approach and Driveway Policy.

Article 8. Minimum Maintenance Policy. Reserved for future use.
