NOTICE OF APPLICATION FOR A LIVESTOCK FEEDLOT PERMIT

Notice is hereby given per Minnesota Statutes, Chapter 115, that Middendorf Family Farm LLC., has made application to the Minnesota Pollution  Control Agency or the County of Stearns for a permit to construct or expand a feedlot with a capacity of 500 Animal Units or more.

The existing and/or proposed feedlot will be located at 40169 County Road 166 Freeport MN in the NE 1/4 of Section 23 in Millwood Township of Stearns County. The existing facility consists of mature dairy and dry cows, 499 mature dairy cows over one thousand pounds for 698.6 Animal units with total and partial confined animal housing, open lots and two earthen liquid manure storage basins and a concrete manure handling system with a pump. The proposed facility consists of mature dairy and dry cows for 699 mature dairy cows over one thousand pounds for 978.6 animal units and total and partial confinement buildings, cattle lane (breezeway)/open lot, earthen liquid manure storage basins, concrete manure handling system with a pump and a proposed 124’x148’ total confinement Dairy Barn and 100’x120’ Freestall Barn for a total of 978.6 Animal Units.

Notice of Public Hearing

-Notice is hereby given, pursuant to Minnesota Statute, Section 394.26, that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct a public hearing on Thursday, September 26, 2019, in Conference Room 121, Stearns County Service Center West, 3301 County Road 138, Waite Park, MN, beginning at 6:30 p.m.

Purpose of the hearing is to consider the granting or denial of variances from the Stearns County Land Use & Zoning Ordinance, Stearns County Subdivision Ordinance, Stearns County Sewage Treatment Ordinance, Stearns County Recreational Campground Ordinance, Stearns County Lodging Establishments Ordinance, Stearns County Childrens Camps Ordinance and the Stearns County Manufactured Home Parks Ordinance as follows:

Public Hearings:

1. To consider a request from Jason & Jolane Stoermann, Melrose, MN from Sections 6.2.1A&F of Stearns County Land Use & Zoning Ordinance #439 to construct a residential accessory structure on a property 4.5–9.49 acres in the shoreland overlay district in excess of the allowed square footage, sidewall height and overall building height.  Said Ordinance allows for a maximum accessory building area of 2400 square feet, a sidewall height of 14 feet and overall building height of 24 feet on a property 4.5-9.49 acres in size.  Affected property:  Lot 8, Block 1 of Kelly Addition, Section 35, T127N, R33W, Melrose Township.  Property address:  32718 Birchfield Court, Melrose, MN.

2. To consider an after the fact request from Scott Elwood – Elwood Septic Professionals, Villard, MN on behalf of Randy & Cheryl Hellermann, Melrose, MN from Sections 5.6.1, 6.1 & 9.2.1H of the Stearns County Subsurface Sewage Treatment System Ordinance #422 to leave as constructed a subsurface sewage treatment systems’ pressure distribution network that exceeds a ten percent variance in flow for all perforations.  Said Ordinance and Minnesota Rule Chapter 7080 require a subsurface sewage treatment systems’ pressure distribution network be designed so there is less than a ten percent variance in flow for all perforations.  Affected property:  Lot 1, Block 1 of Hellermann Acres, Section 6, T124N, R33W, Spring Hill Township.  Property address:  31969 County Road 175, Melrose, MN.
