OFFICIAL SUMMARY OF ORDINANCE NO. 1, 2018

AN ORDINANCE PROVIDING FOR REGULATION OF

ADULT ESTABLISHMENTS IN THE CITY OF MEIRE GROVE, MINNESOTA

The following is the official summary of Ordinance No. 1, 2018, which was passed by the City Council on December 11, 2018.

A printed copy of this ordinance is available for inspection by any person at the office of the City Clerk or upon request to the City Clerk, and a fully copy of the ordinance will be posted on the City’s bulletin board.

This ordinance regulates a variety of adult use establishments.

Section 1, Subd. 1, recites the authority relied upon by the City for this regulation.

Section 1, Subd. 2, recites findings made by the Council related to adverse impacts of adult uses and the need for reasonable regulation.

Section 1, Subd. 3, recites the purpose or goals of the ordinance.

Section 1, Subd. 4, acknowledges that the ordinance does not prohibit adult uses, but regulates those uses.

In Section 2 there are various definitions relevant to the ordinance.  

Section 3 provides a general prohibition against conduct not allowed under the ordinance.

Section 4 places limitations on the location of adult uses.

Section 5 regulates the hours of operation of adult uses.

Section 6 relates the manner in which adult uses may be operated and restricts certain conduct in adult use establishments.

Section 7 requires a license for an adult use establishment.

Section 8 provides information that must be contained in an application and the process to be followed in reviewing applications.

Section 9 sets forth items which may disqualify an applicant from obtaining a license.

Section 10 is the procedure for annual renewal of a license.

Section 11 sets forth the basis on which a license may be suspended.

Section 12 sets forth the basis on which a license may be revoked.

Section 13 sets up an appeals process for licensees whose licenses are suspended or revoked and a procedure for obtaining judicial review.

Section 14 provides that the license, if granted, must be posted.

Section 15  provides annual license fee information.

Section 16 sets up a process for inspection of licensed premises from time to time.

Section 17 provides that licenses are not transferable.

Section 18 provides that violations of this ordinance are a misdemeanor.

Section 19 provides that the individual provisions of the ordinance are severable.

This summary was approved by the City Council of Meire Grove, Minnesota, on December 11, 2018.  The Council reviewed this summary and has determined that publication of this summary will clearly inform the public of the intent and effect of this ordinance.

It is Ordered and Notice is given that on January 25, 2019, at 8:45 a.m., a hearing will be held in this Court at St. Cloud, Minnesota, on a petition for the adjudication of intestacy and determination of decedent’s heirs, and for the appointment of Margaret Overman, whose address is 38207 County Road 11, Freeport, MN 56331, as personal representative of the decedent’s estate in an unsupervised administration.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the personal representative will be appointed with the full power to administer the decedent’s estate, including power to collect all assets; to pay all legal debts claims, taxes, and expenses; to sell real and personal property; and to do all necessary acts for the decedent’s estate.

Notice is further given that, subject to Minn. Stat. 524.3-801, all creditors having claims against the decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.

Notice of Public Hearing

Notice is hereby given that the Stearns County Planning Commission, in and for the County of Stearns, will conduct a public hearing to consider a Conditional Use Permit application for a Major Shoreland Alteration submitted by Jerry Konz of JK Landscape Construction LLC on behalf of Costello Family Trust of Grey Eagle, MN according to the requirements of Sections: 10.2.11B(3), 10.2.14B(3) and 10.2.14I(2)(c) of Stearns County Land Use and Zoning Ordinance #439 to excavate and fill 96 cubic yards of material, place natural fieldstone rip rap along the shoreline, and construct a boulder retaining wall greater than 25 percent of the lot width as measured at the Ordinary High Water Level.  The property under consideration is located at 44496 Birch Park Trail, Grey Eagle, MN on Lot 001 Block 001 of Birch Park Estates, Section 32, T127N, R32W, Millwood Township.

Notice is further given that the above hearing will be held on Thursday, January 17, 2019 beginning at 7:00 PM at the Stearns County Service Center West, 3301 County Road 138 Room 121, Waite Park, Minnesota.        

A copy of the proposed request is on file in the Stearns County Environmental Services Office, County Administration Center, 705 Courthouse Square Room 343, St. Cloud, Minnesota and can be viewed during regular business hours.  This request/information can also be viewed approximately one week prior to the meeting at co.stearns.mn.us by clicking on Board & Committee Meetings.  Action taken on this application will be available shortly after the meeting at the same website location.  

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date either in support of or in opposition to the proposed request.  Written testimony should be submitted to the Stearns County Environmental Services Department, Administration Center, 705 Courthouse Square Room 343, St. Cloud, Minnesota 56303.
