Notice of Public Hearing

Notice is hereby given that the Stearns County Planning Commission, in and for the County of Stearns, will conduct a public hearing to consider a request for a conditional use permit submitted by Hemker Property LLC of Freeport, MN according to the requirements of Section 4.4, 4.6, 4.8, 4.14, 6.5, 6.7 and 9.3 of Stearns County Land Use and Zoning Ordinance #439 to continue to operate a park and zoo as an agriculturally oriented business and expand their current zoo operation by adding a 3,050 square foot partial confinement barn attached to a 1,700 square foot open lot, a 30 by 60 foot open lot, a 13,100 square foot open lot, a 16 by 32 foot partial confinement barn, a 16 by 24 foot partial confinement barn, a 14 foot diameter partial confinement barn, a 8 by 12 foot partial confinement barn, a 90 by 180 foot partial confinement barn, two,16 foot diameter partial confinement barns, and a 35 by 60 foot total confinement barn. The feedlot is currently registered for 27.827 Animal Units (AU) consisting of zoo animals, the applicant is proposing to expand the number of animal units to 49.956 consisting of zoo animals. The property under consideration is located in the N ½ of the NE ¼ in Section 2 of Oak Township.  The property address is 26705 County Road 39 Freeport, MN.

Notice is further given that the above hearings will be held on Thursday, October 18, 2018 beginning at 7:00 PM at the Stearns County Service Center West, 3301 County Road 138, Room 121, Waite Park, Minnesota.        

A copy of the proposed request is on file in the Stearns County Environmental Services Office, County Administration Center, 705 Courthouse Square, Room 343, St. Cloud, Minnesota and can be viewed during regular business hours.  This request/information can also be viewed approximately one week prior to the meeting at co.stearns.mn.us by clicking on Board & Committee Meetings.  Action taken on this application will be available shortly after the meeting at the same website location.  

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date either in support of or in opposition to the proposed request.  Written testimony should be submitted to the Stearns County Environmental Services Department, Administration Center, 705 Courthouse Square, Room 343, St. Cloud, Minnesota 56303.

OFFICIAL TITLE AND SUMMARY ORDINANCE NO. 2018-03

AN ORDINANCE AMENDING THE FREEPORT CITY CODE OF 1995,

CHAPTER V, SECTION 500 ZONING, PLANNING AND LAND USE 

WITHIN THE CITY OF FREEPORT, MINNESOTA

The following Official Summary of Ordinance No. 2018-02, “An Ordinance Amending the Freeport City Code of 1995, Chapter V, Section 500 Zoning, Planning and Land Use within the City of Freeport, Minnesota” has been approved by the City Council of the City of Freeport, Minnesota, as clearly informing the public of the intent and effect of the Ordinance.



SECTION 1.  Adds definitions regarding solar energy systems.

SECTION 2.  Adds roof mounted solar energy systems as a permitted accessory use in the A, Agriculture/Rural Residence District.

SECTION 3.  Removes solar energy as a permitted use in the R-1, Single and Two-Family Residence District.

SECTION 4.  Adds roof mounted solar energy systems as a permitted accessory in the R-1, Single and Two-Family Residence District.

SECTION 5.  Adds roof mounted solar energy systems as a permitted accessory in the C-1, Central and Neighborhood Commercial District.

SECTION 6.  Adds roof mounted solar energy systems as a permitted accessory use in the I-1, General Industrial District.

SECTION 7.  Adopts performance standards for Solar Energy Systems in the City of Freeport.

SECTION 8.  Removes allowance of variances for solar collectors from height and yard  esceptions.

SECTION 9.  Effective Date.  This Ordinance shall take effect upon its passage and publication of this Official Title and Summary.

A printed copy of the Ordinance is available for inspection by any person at the Office of the City Clerk.
