ORDINANCE NO. 11-15-2018-2

A SUMMARY ORDINANCE AMENDING ZONING ?ORDINANCE NO. 1989-1-A AS AMENDED, ADOPTED BY REFERENCE AS CHAPTER 153 OF THE MELROSE CITY CODE AMENDING CHAPTER 600, GENERAL REGULATIONS, BY REPEALING AND REPLACING SECTION 700, SIGN REGULATIONS
THE CITY COUNCIL OF THE CITY OF MELROSE, ORDAINS AS FOLLOWS:

1. The City Council has adopted a lengthy ordinance amendment modifying the General Regulations section of the Zoning Ordinance by repealing and replacing Section 700, Sign Regulations.  The purpose of this summary is to inform the public of the intent and effect of the ordinance and to publish only a summary of the ordinance.  

2. Section 700 of Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is amended by repealing and replacing Section 700, Sign Regulations.  The modifications are summarized and provide essentially as follows:

SECTION 700. Sign Ordinance

701. Purpose -  sets forth the purpose for sign regulations

702. Findings – sets forth the benefits of signage and the need for balancing signage with appropriate regulations.

703.  Application of Regulations and Substitution Clause – provides an overview of when the regulations are relevant and what can be substituted regarding the requirements.  

704.  Severability – establishes what happens if part of the ordinance is deemed invalid

705.  Definitions – defines relevant signage terms.

706.  Scope – states that the primary scope of this section shall be to regulate signs of a commercial nature intended to be viewed from any vehicular or pedestrian public right-of-way, and defines the elements that are not regulated by these regulations.  

707.  Permits and General Requirements – outlines the need for permitting

708.  Exemptions – provides a list of signs that are allowed without a permit.  

709.  Prohibited Signs – lists the signs that are not allowed within the City

710.  District Sign Regulations – provides sign regulations relevant to each zoning district.  

711.  Specific Sign Regulations – provides regulations specific to particular types of signs or uses.  

712.  Billboard Overlay District – provides regulations related to billboards 

713.  Administration – provides the process for sign applications and review

714.  Sign Maintenance – outlines the need for sign maintenance and responsible parties and process for compliance.  

3. The City Council has determined that publication of the title and summary of Ordinance 11-15-2018-2 as set forth in this summary will clearly inform the public of the intention and effect of the ordinance. The Council also directs that only the title and this summary be published.  A copy of the entire text of the ordinance is available for inspection by any person during regular office hours at the office of the City Clerk and shall be posted in the Melrose library.

4. This Ordinance shall be effective following its passage and publication.

NOTICE GROVE TOWNSHIP

Snow dumped on roads dangerous and illegal

Come winter, you’ll want to watch where you push the snow from your driveway and sidewalks. Shoveling, blowing or plowing snow from your property onto a public road or street can get you into trouble. It’s against state law and may be punishable as a misdemeanor. Misdemeanor offenses can carry a fine of up to $700 and/or a jail sentence of up to 90 days.

Snow dumped, plowed or shoveled onto a roadway can create a real hazard for drivers and also for snowplows. Even heavy snowplows have been damaged when hitting compacted and frozen snow deposited on the highways.

In some parts of the county, snow pushed onto a highway causes snowdrifts, which are hazardous to drivers. The person responsible for putting snow onto the highway may be liable in a civil lawsuit if damages or injuries occur as a result of the action.

We urge residents, as good neighbors and drivers themselves, not to add to the hazards of wintertime driving in this way.

ORDINANCE NO. 11-15-2018-1

AN ORDINANCE REPEALING ORDINANCE NO. 2003-C

AND ADOPTING CABLE SYSTEM REGULATIONS

The following Official Summary of Ordinance No. 11-15-2018-1, entitled “An Ordinance Repealing Ordinance No. 2003-C and Adopting Cable System Regulations,” has been approved by the City Council of the City of Melrose, Minnesota, as clearly informing the public of the intent and effect of the Ordinance.

The Ordinance repeals Ordinance No. 2003-C, entitled “City of Melrose Cable Systems Regulations,” and replaces updated Cable System Regulations within the City of Melrose.

It is the intent of this Ordinance to serve the public convenience, safety, and general welfare by establishing cable regulatory powers vested in the City and to provide for and specify the means to attain the best possible cable service to the public.

The Ordinance applies to every cable franchise granted within the City.  It contains a section of definitions, which defines various terms contained in the Ordinance.

The Ordinance requires every cable service provider to obtain a franchise to operate within the City and establishes the minimum cable service and system requirements for obtaining a franchise.

The Ordinance establishes customer service requirements, requires payment to the City of a franchise fee, regulates the installation of cable service equipment in public right of ways, and sets minimum technical standards for cable systems.

The Ordinance establishes minimum standards of financial responsibility for cable service providers and creates procedures for the City to monitor the cable service provider’s continued financial responsibility during the term of a franchise.

The Ordinance establishes administrative procedures for the City to revoke franchises in the event of a material breach of the Ordinance or a Franchise Agreement.  Procedures are created for disposition of property abandoned by cable service providers upon termination or revocation of a Franchise Agreement

A printed copy of the Ordinance is available for inspection by any person at the Office of the City Administrator.

This Ordinance shall be in full force and effect from and after its passage and publication of this Official Title and Summary.

Notice is hereby given that a hearing will be held before the Melrose Planning and Zoning Commission on Monday, December 3 at 6:30 p.m. at the Melrose City Center, 225 1st Street NE, Melrose, MN, to consider a Preliminary Plat and Variance request submitted by Melrose Dairy Proteins, LLC.  The plat includes land currently addressed as 1000 Kraft Drive and 1010 Kraft Drive.  The purpose of the new plat is to relocate portions of existing lot lines within the interior of the current plat and create one additional interior lot.  A variance is required as not all lots meet ordinance standards for setbacks, frontage and other ordinance requirements.  The lots are being reconfigured to allow a portion of land to change ownership between the two existing property owners.  The request relates to real property in the City of Melrose, legally described as follows:  Lots 1 and 2, Block 1, Melrose Dairy Proteins, according to the plat thereof recorded in the office of the County Recorder, Stearns County, Minnesota.  A copy of the proposed request is available for review at the Melrose City Center during normal business hours.  Dated this 16th of November, 2018.
