AN ORDINANCE SUMMARIZING AND REAFFIRMING FEES FOR CITY LICENSES, PERMITS AND SERVICES, ESTABLISHING A SCHEDULE OF FINES, AND PROVIDING FOR SUBSEQUENT REVIEW, MODIFICATION AND AMENDMENT

THE CITY COUNCIL OF THE CITY OF MELROSE, STEARNS COUNTY, MINNESOTA HEREBY ORDAINS:

SECTION 1. RECITALS. 

A. The Melrose City Code establishes certain fees which can be set from time to time by the City Council, and 

B. The City Council has determined it is in the best interests of the citizens of the City to establish a master fee schedule to ensure that established fees for licenses, permit, services and fines are fair, reasonable, and proportionate to the actual cost of the circumstance for which the fee is imposed. 

SECTION 2. FEE AND FINE SCHEDULE. Exhibit A shall be the fee and fine schedule for the City of Melrose. 

SECTION 3. FEES AND FINES NOT COVERED. Any fee or fine previously established, but not included in Exhibit A, shall continue in full force and effect. 

SECTION 4. AMENDMENT. The City Council of Melrose reserves its authority to, from time to time, review the schedule of fees and fines and to make such additions, deletions, or modifications as it deems necessary and appropriate. 

SECTION 5. EFFECTIVE DATE. This Ordinance shall become effective from and after due passage and enactment and publication according to law.

ORDINANCE NO. 12-13-2018-1

A SUMMARY ORDINANCE AMENDING PORTIONS OF 

SUBSECTIONS 222.04(1) and 222.04(10) CONDITIONAL USES IN C-2, COMMERCIAL HIGHWAY;

SUBSECTION 501.03 REGARDING OFF STREET 

PARKING REQUIREMENTS; 

AND 

SECTION 2100, THE LANDSCAPING AND SCREENING

OF ZONING ORDINANCE NO. 1989-1-A AS AMENDED, ADOPTED BY REFERENCE AS CHAPTER 153 OF THE MELROSE CITY CODE AMENDING CHAPTER 600, GENERAL REGULATIONS 

THE CITY COUNCIL OF THE CITY OF MELROSE, ORDAINS AS FOLLOWS:

1. The City Council has adopted a lengthy ordinance amendment modifying the General Regulations section of the Zoning Ordinance by amending several sections of the Zoning Ordinance. The purpose of this summary is to inform the public of the intent and effect of the ordinance and to publish only a summary of the ordinance.  

2. Subsection 222.04(1) (relating to Commercial establishments in the C-2, Commercial Highway District requiring outdoor display and sales) of Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is hereby amended as follows, adding specifications regarding design standards for outdoor display areas, requiring a permanent structure on the parcel unless meeting specific criteria, and excluding seasonal sales areas such as spring plant sales, fireworks sales and similar uses when meeting other City codes.  

3. Subsection 222.04(10) (relating to motor vehicle and recreational vehicle sales) of Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is hereby amended by repealing the entire subsection as the standards were included in Subsection 222.04(1) as noted above.  

4. Section 501.03, Location of Parking Spaces, within the Off-Street Parking and Loading Requirements, a subsection of Section 500, Parking, Loading and Storage Regulations of Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is hereby amended by clarifying the existing parking setback requirements and removing the landscape and parking buffer requirement in the C-2, Highway Commercial District when abutting a Minor Arterial road of at least 100 feet in width when specific criteria are met.  

5. Section 2100, Landscaping and Screening, of the Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is amended by repealing and replacing Section 2100, Landscaping and Screening. The modifications are summarized and provide essentially as follows:

The Council also directs that only the title and this summary be published. A copy of the entire text of the ordinance is available for inspection by any person during regular office hours at the office of the City Clerk and shall be posted in the Great River Regional Library – Melrose branch.

7. This Ordinance shall be effective following its passage and publication.
