ADVERTISEMENT FOR BIDS

Sealed bids will be received by the City Clerk of Melrose, Minnesota, at the Melrose City Center, 225 1st St. NE, Melrose, MN 56352, until 1:30 p.m. on the 17th day of April 2018, for East Substation Addition – 2018, at which time the bids shall be publicly opened and read aloud.

The general nature of the work on which bids will be received consists of construction of a 69 kV substation upgrade, including concrete foundations, power cable, control building modifications, and all associated equipment.  This also includes the installation of Owner-furnished circuit switcher, steel structures, laminated wood poles, CVTs, lightning arresters, three-way switch, and connecting to power transformers, switchgear, and control panels.

The above work shall be in accordance with the specifications and proposed form of contract now on file in the office of the Melrose Public Utilities, Melrose, Minnesota, by this reference made a part hereof as though fully set out and incorporated herein.

The Contractor and all subcontractors shall submit to the Owner a signed statement verifying compliance with each of the criteria described in the State of Minnesota “Responsible Contractor” law as codified in Minnesota Statute section 16C.285.  See the Instructions to Bidders for more details.

All bids shall be made on proposal forms furnished by the Engineer and shall be accompanied by bid security in the form of a certified check or bid bond, made payable to Melrose Public Utilities, in the amount of ten percent (10%) of the bid, which security becomes the property of Melrose Public Utilities in the event the successful bidder fails to enter into a contract and post satisfactory performance and payment bonds.

Payment to the Contractor will be made on the basis of ninety percent (90%) upon certification of work completed; ten percent (10%) thirty-one (31) days after final completion and acceptance.

The construction shall be performed upon a Notice to Proceed issuance.  Substantial completion of the project shall be no later than November 1, 2018.  See the specifications for more details on construction timing requirements.

Melrose Public Utilities reserves the right to defer acceptance of any proposal for a period not to exceed thirty (30) days after the date proposals are received and no proposal may be withdrawn during this period.  Melrose Public Utilities also reserves the right to reject any or all bids and enter into such contract as it shall deem to be in the best interest of Melrose Public Utilities.

It is Ordered and Notice is given that on April 20, 2018 at 8:45 a.m., a hearing will be held in this Court at St. Cloud, Minnesota, on a petition for the adjudication of intestacy and determination of decedent’s heirs, and for the appointment of Jason Primus, whose address is 702 – 9th Ave N., St. Cloud, MN  56303, and Ruth Primus, whose address is 8858 Spring Lane, Woodbury, MN  55125, as personal representatives of the decedent’s estate in an unsupervised administration.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing.  If the petition is proper and no objections are filed or raised, the personal representatives will be appointed with the full power to administer the decedent’s estate, including the power to collect all assets; to pay all legal debts, claims, taxes, and expenses; to sell real and personal property; and to do all necessary acts for the decedent’s estate.

Notice is further given that, subject to Minn. Stat. § 524.3-801, all creditors having claims against the decedent’s estate are required to present the claims to the personal representatives or to the Court within four (4) months after the date of this notice or the claims will be barred.

APPLICATION FOR 

VACATION OF ALLEYS 

1. That this application is brought pursuant to Minn. Stat. §505.14 seeking the vacation of certain alleys as shown on the plat of the Townsite of Melrose, on file and of record in the office of the Stearns County Recorder, Stearns County, Minnesota.

2. That this application seeks vacation of the entire alley located in Block 32, the entire alley located in Block 35 and the entire alley located in Block 36, all in the Plat of the Townsite of Melrose. 

3. That the Church of St. Mary of Melrose is the owner of all of the lots in said Block 32, Block 35 and Block 36, in said Plat of the Townsite of Melrose. 

4. Applicant believes that said alleys were vacated many years ago, but it has been unable to locate any documentation confirming the same.  Applicant and its predecessors in title have long occupied the alleyway properties in question, and have constructed improvements on the same, all of which have been in place in excess of 30 years.   Applicant further avers that none of the alleys in question have been utilized by the public during this time for any purpose.  

5. That upon vacation, Applicant, the Church of St. Mary of Melrose is entitled to all of the vacated alleys described above, since said Applicant owns all of the lots on both sides of each of said alleys, and there are no other abutting land owners.  

6. Any party requesting future notice of proceedings relative to this Application shall so notify the attorney for Applicant, providing in writing their name and address to which future notices may be directed.  The name and address of the attorney for the Applicant is as follows:  Daniel T. Zimmermann, Willenbring, Dahl, Wocken & Zimmermann, PLLC, 318 Main Street – PO Box 417, Cold Spring, Minnesota 56320.

WHEREFORE, the undersigned respectfully requests the Court to grant this Application and adjudge the following:

a. That the platted alleys described in paragraph 2 above be vacated.  

b. That the Applicant set forth above constitutes the only owner of all of the lots abutting said alleys subject to the proposed vacation.  

c. That no persons owning or occupying land affected by the proposed vacation are in any way damaged.

d. That payment of compensation to any party is not required by virtue of the vacation as no party was damaged by the vacation.
