It is Ordered and Notice is given that on April 20, 2018 at 8:45 a.m., a hearing will be held in this Court at St. Cloud, Minnesota, on a petition for the adjudication of intestacy and determination of decedent’s heirs, and for the appointment of Jason Primus, whose address is 702 – 9th Ave N., St. Cloud, MN  56303, and Ruth Primus, whose address is 8858 Spring Lane, Woodbury, MN  55125, as personal representatives of the decedent’s estate in an unsupervised administration.

Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing.  If the petition is proper and no objections are filed or raised, the personal representatives will be appointed with the full power to administer the decedent’s estate, including the power to collect all assets; to pay all legal debts, claims, taxes, and expenses; to sell real and personal property; and to do all necessary acts for the decedent’s estate.

Notice is further given that, subject to Minn. Stat. § 524.3-801, all creditors having claims against the decedent’s estate are required to present the claims to the personal representatives or to the Court within four (4) months after the date of this notice or the claims will be barred.

VACATION OF CERTAIN ALLEYS AS DEDICATED IN THE PLAT OF THE TOWNSITE OF MELROSE,

APPLICATION FOR 

VACATION OF ALLEYS 

1. That this application is brought pursuant to Minn. Stat. §505.14 seeking the vacation of certain alleys as shown on the plat of the Townsite of Melrose, on file and of record in the office of the Stearns County Recorder, Stearns County, Minnesota.

2. That this application seeks vacation of the entire alley located in Block 32, the entire alley located in Block 35 and the entire alley located in Block 36, all in the Plat of the Townsite of Melrose. 

3. That the Church of St. Mary of Melrose is the owner of all of the lots in said Block 32, Block 35 and Block 36, in said Plat of the Townsite of Melrose. 

4. Applicant believes that said alleys were vacated many years ago, but it has been unable to locate any documentation confirming the same.  Applicant and its predecessors in title have long occupied the alleyway properties in question, and have constructed improvements on the same, all of which have been in place in excess of 30 years.   Applicant further avers that none of the alleys in question have been utilized by the public during this time for any purpose.  

5. That upon vacation, Applicant, the Church of St. Mary of Melrose is entitled to all of the vacated alleys described above, since said Applicant owns all of the lots on both sides of each of said alleys, and there are no other abutting land owners.  

6. Any party requesting future notice of proceedings relative to this Application shall so notify the attorney for Applicant, providing in writing their name and address to which future notices may be directed.  The name and address of the attorney for the Applicant is as follows:  Daniel T. Zimmermann, Willenbring, Dahl, Wocken & Zimmermann, PLLC, 318 Main Street – PO Box 417, Cold Spring, Minnesota 56320.

WHEREFORE, the undersigned respectfully requests the Court to grant this Application and adjudge the following:

a. That the platted alleys described in paragraph 2 above be vacated.  

b. That the Applicant set forth above constitutes the only owner of all of the lots abutting said alleys subject to the proposed vacation.  

c. That no persons owning or occupying land affected by the proposed vacation are in any way damaged.

d. That payment of compensation to any party is not required by virtue of the vacation as no party was damaged by the vacation.

ASSESSORS TO REVIEW 

PROPERTY VALUATION AND CLASSIFICATION QUESTIONS

Melrose City Assessors, Deb Haus and Kathy Korte, have announced that they will be available to answer questions regarding the 2018 estimated market values and tax classifications of city properties at the Melrose City Center, on Wednesday, April 4, 2018 from 4:00 p.m. to 5:00 p.m.

This informational meeting is an opportunity to meet informally with the assessors prior to the scheduled Local Board of Appeal and Equalization meeting.  They will address your assessment questions and review property and sales data with you.  They will also talk about various property tax laws and programs.  

This meeting does not replace a property owner’s right to submit an appeal before the Local Board of Appeal and Equalization meeting scheduled for Thursday, April 19, 2018 from 4:30 p.m. to 5:00 p.m. at the Melrose City Center.  The Local Board of Appeal and Equalization meeting is held to address the grievances of property owners who choose to appeal their 2018 estimated market value and/or tax classification.  It is conducted according to the laws of the state and plays an important role in the property appeals process.

PUBLIC NOTICE

(Rezoning Public Hearing)

Application for a Rezoning has been submitted to the City of Melrose Planning and Zoning Department by the City of Melrose in behalf of Casey Retail Store in accordance with Section 1200 of the City’s Zoning Regulation. If granted, the requested Rezone will allow the rezoning in accordance with the Comprehensive Plan and allow the uses as described within the Zoning Regulation within a Highway Commercial Zone (C2).  The City of Melrose Planning and Zoning Commission will hold a public hearing on Monday, April 2, 2018 beginning at 6:30 p.m., or as soon thereafter as the matter may be heard, at the Melrose City Center for taking public input regarding the requests and to consider the granting or denial of them.

The requested Rezone will change the potential initial zoning if granted annexation from Future Developmental District to Highway Commercial Zone of the current Parcel ID 12.06926.0002:  It is legally described as: That part of the Northeast Quarter of the Southeast Quarter (NE¼ SE¼) of Section 3, Township 125 North, Range 33 West, Stearns County, Minnesota, which lies southerly of the south line of Block Two (2) of Darmac Acres, according to the plat thereof, on file and of record in the office of the Stearns County Recorder, and northwesterly of the northwesterly right of way line of County State Aid Highway 13, according to Stearns County Highway Right of Way Plat Number 35, on file and of record in the office of the Stearns County Recorder.
