ORDINANCE NO. 07-19-2018-3

A SUMMARY ORDINANCE AMENDING SECTION 1600, GENERAL FENCE AND WALL STANDARDS,

 OF ZONING ORDINANCE NO. 1989-1-A AS AMENDED, 

ADOPTED BY REFERENCE AS CHAPTER 153 OF THE MELROSE CITY CODE

THE CITY COUNCIL OF THE CITY OF MELROSE, ORDAINS AS FOLLOWS:

1. The City Council has adopted a lengthy ordinance amendment modifying the fence standards and setback requirements to allow fences to be closer than three feet from the property line when meeting specific criteria.  The purpose of this summary is to inform the public of the intent and effect of the ordinance and to publish only a summary of the ordinance with the full ordinance being on file in the office of the City Clerk during regular office hours.

2. Section 1606 of Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is amended by modifying a portion of Section 1600, Fence and Wall Regulations, Subsection 1606 General Fence and Wall Standards.  The modifications provide essentially as follows:

SECTION 1600. FENCE AND WALL REGULATIONS 

1606. General Fence and Wall Standards 

Describes the standards for walls and fences.  Modifies the ordinance by adding a process that allows reducing the fence setback from 3 feet to 0 feet.  

3. The City Council has determined that publication of the title and summary of Ordinance 07-19-2018-3 as set forth in this summary will clearly inform the public of the intention and effect of the ordinance. The Council also directs that only the title and this summary be published. A copy of the entire text of the ordinance shall be posted in the Melrose library.

4. This Ordinance shall be effective immediately upon its passage and publication.

ORDINANCE NO. 07-19-2018-2

A SUMMARY ORDINANCE AMENDING PORTIONS OF SECTIONS 200, 400, 1700 AND 2100 OF THE ZONING ORDINANCE NO. 1989-1-A AS AMENDED, ADOPTED BY REFERENCE AS CHAPTER 153 OF THE MELROSE CITY CODE RELATING TO MIXED USES AND CREATING A C-5 COMMERCIAL/RESIDENTIAL DOWNTOWN DISTRICT

THE CITY COUNCIL OF THE CITY OF MELROSE, ORDAINS AS FOLLOWS:

1. The City Council has adopted a lengthy Ordinance amendment modifying various sections of the Zoning Ordinance related to mixed uses and creating a new C-5 Mixed Use Zoning District.  The purpose of this summary is to inform the public of the intent and effect of the ordinance and to publish only a summary of the ordinance with the full ordinance being on file in the office of the City Clerk during regular office hours.

2. The Melrose Zoning Ordinance No. 1989-1-A, as amended, and adopted by reference as Chapter 153 of the Melrose City Code is amended by modifying portions of Sections 200, 400, 1700 AND 2100 as summarized below.  The modifications provide essentially as follows:

SECTION 200. DISTRICT USE AND REGULATIONS

Adds a new zoning category, C-5 Commercia/Residential Downtown.  Describes the intent of this district, lists the permitted uses, permitted accessory uses and uses by conditional use permit.  Defines the design standards for Mixed Use buildings zoned C-4 or C-5.  

SECTION 400. DISTRICT LOT REGULATIONS

Sets the minimum lot sizes, dimensions, setbacks, maximum height, and lot coverage.

SECTION 1700.  WIND ENERGY CONVERSION SYSTEMS

Adds the new C-5 district to this Section of the ordinance.  

SECTION 2100. LANDSCAPING AND SCREENING 

Provides landscaping requirements for the new C-5 district.

3. The City Council has determined that publication of the title and summary of Ordinance 07-19-2018-2 as set forth in this summary will clearly inform the public of the intention and effect of the ordinance. The Council also directs that only the title and this summary be published.  A copy of the entire text of the ordinance is available for inspection by any person during regular office hours at the office of the City Clerk and shall be posted in the Melrose library.

4.  This Ordinance shall be effective immediately upon its passage and publication.

NOTICE IS HEREBY GIVEN, that The Melrose Planning and Zoning Commission will meet at 6:30 p.m. on August 6, 2018, at the City Center, 225 First Street NE, in the City of Melrose, for the purpose of giving consideration to the Rezoning request proposed by the City of Melrose regarding the former downtown Kraft site located at 325 1st St. NE Melrose, MN 56352.  The Property is described as follows:  Lot One (1), Block One (1) of Melrose Riverview Addition, according to the plat and survey thereof, now on file and of record in the office of the Stearns County Recorder.

The rezoning is an amendment to City of Melrose Zoning Ordinance No.1989-1-A, as amended, and adopted by reference as Chapter 153 of the City of Melrose Code of Ordinances.  The zoning of the parcel is proposed to change from R-1, Residential to C-5, Commercial/Residential Downtown District.
