1.1 NOTICE TO CONTRACTORS

Sealed Bid Proposals for the furnishing of all labor, materials and all other items necessary to complete the work described herewith, will be received by Sauk River Watershed District at its office located at 524 4th St. S, Sauk Centre, MN, until 3:00 PM January 11, 2018, at which time such bids will be opened and read aloud.  The work, in accordance with drawings and specifications prepared by Wenck Associates, Inc. consists of the following major items of work:

• Approximately 13,110 LF of ditch cleaning including excavation, grubbing, vegetation removal, and disposal of materials via spreading and leveling soils 

• Approximately 2,590 LF of ditch cleaning including vegetation and brush removal only

• Beaver dam removal (5)

• Salvage of rock check dams (3)

• Approximately 133 CY of Class II Riprap at lateral ditch inlets, existing drain tile outlets (including geotextile underlayment)

• Culvert replacement (3), and approximately 217 CY Class III Riprap stabilization with geotextile

• Buffer Establishment, Site Restoration and Erosion Control

The bid package is available for examination at the Wenck office, 7500 Highway 55, Suite 300 Golden Valley MN 55427-4800 and at the Sauk River Watershed District office at 524 4th St. S, Sauk Centre, MN 56378.  All communications made prior to bid opening, relative to this project, should be addressed to the ENGINEER Attn: Rebecca Carlson, Project Engineer, rcarlson@wenck.com or 763-252-6824.

Bid Proposals shall be submitted on forms furnished for that purpose.

Each bid proposal shall be accompanied by a “Bid Security” in the form of a certified or cashier’s check made payable to Sauk River Watershed District (“OWNER”) in an amount not less than five percent (5%) of the total bid, or a surety bond in the same amount, running to the OWNER, with a surety company duly authorized to do business in the state of Minnesota, such Bid Security to be a guarantee that the bidder, if awarded a contract, will enter into a contract with Sauk River Watershed District; and the amount of the certified check will be retained or the bond enforced by the OWNER in case the bidder fails to do so.  The OWNER will retain the deposits for the three lowest bidders until the contract has been awarded and executed but not longer than sixty (60) days.  No bid may be withdrawn for a period of sixty (60) days following the bid opening.

A PRE-BID meeting will be held January 5, 2018, at 11:30AM at the Sauk River Watershed District office located at 524 4th St. So, Sauk Center, MN.

The bid of the lowest responsible bidder is intended to be accepted on or before the expiration of sixty (60) days after the date of the opening of bids.  The OWNER, however, reserves the right to reject any or all bids and to wave any minor irregularities, informalities or discrepancies, and further reserves the right to award the contract in the best interest of Sauk River Watershed District.

If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer. 

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. 7. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY.

This lawsuit involves, affects, or brings in question real property located at 198 West  Street,  St. Martin, Stearns County, Minnesota; the record legal description of the property is as follows:

That part of the Northeast Quarter of the Southwest Quarter of Section 35, Township 124, Range 32, Stearns County, Minnesota and that part of Lots 42 and 44, AUDITOR’S SUBDIVISION NO. 7, according to the recorded plat thereof, in Section 35, Township 124, Range 32, Stearns County, Minnesota, decribed as follows: Commencing at the South Quarter corner of said Section 35; thence North 00 degrees 04 minutes 52 seconds East, assumed bearing, along the north-south quarter line of said Section 35, 1624.96 feet; thence North 89 degrees 55 minutes 08 seconds West, 103.01 feet, to the westerly right of way of Coutny Road No. 12 and the point of beginning of the tract to be described; thence South 83 degrees 56 minutes 32 seconds West, 198.23 feet; thence North 10 degrees 36 minutes 53 seconds West, 168.00 feet; thence North 83 degrees 56 minutes 32 seconds East, 196.82 feet, to said westerly right of way of County Road No. 12; thence South 11 degrees 05 minutes 37 seconds East, along said right of way, 168.12 feet, to the point of beginning.

8. THE OBJECT OF THIS LAWSUIT. The object of this lawsuit is to quiet the title to the property (survey legal description) and to determine the adverse claims thereto and further to obtain the Judgement of the Court adjudging that Plaintiffs, Craig Bardson and Lori Bardson  are the owners in fee simple absolute, as joint tenants, of the subject property as legally described in the survey legal description and further adjudging that Defendants, nor any of them, have any right, title, estate or interest therein, nor lien thereon.
