ORDINANCE NO. 228
The following is a summary of the City of Avon, Zoning Ordinance amendments which was adopted on May 2, 2022 by the City Council, of the City of Avon, Stearns County, Minnesota.
Amend all zoning districts to include as a conditional use:
Ground source heat pump systems in public waters may be permitted subject to the following:
1. Approval from the Minnesota Department of Natural Resources.
2. Written consent of all property owners and/or approval by an association in accordance with its adopted bylaws.
3. Demonstrated compliance with applicable city permit requirements.
And
To remove chapter 21 General District Provisions, Subd. 4, E., 2., e.
Building height limits established for districts shall not apply to the following providing said structures do not exceed two hundred (200) feet above ground level:
a. Cooling Towers
b. Elevator penthouses
c. Flag poles
d. Monuments
e. Windmills

APPROVAL OF PROPERTY TAX ABATEMENT
and
PROPOSED BUSINESS SUBSIDY FOR SHAMROCK LANE RENTALS LLC
Notice is hereby given that the City Council of the City of Albany, Minnesota (the “City”) will meet beginning at 6:30 p.m. on Wednesday, June 15, 2022, at the City Hall, 400 Railroad Avenue, Albany, Minnesota, to conduct public hearings to consider the following:
Granting a property tax abatement under Minnesota Statutes, Sections 469.1812 to 469.1815, to assist the construction of a new commercial facility within the City (the “Property”). The Property is described as follows:
Tax Parcel No. 40.25444.0100
The tax abatement to be collected by the City shall not exceed a period of fifteen years commencing with taxes payable 2024. The maximum cumulative amount of the abatement shall not exceed $250,000 over that fifteen year period.
And:
Relating to the proposed business subsidy agreement with Shamrock Lane Rentals LLC, pursuant to Minnesota Statutes, Section 116J.993 through 116J.995, inclusive, as amended.
Any person with residence in or owner of taxable property in the City of Albany may file a written complaint with the City if the City fails to comply with the Minnesota Statute noted above. If written notice is not filed with the City, no action may be taken against the City for failure to comply.
A draft copy of the abatement resolution containing the terms of the abatement, and a summary of the Business Subsidy Agreement, will be on file at City Hall and available for public inspection on and after the date of this notice. Any person wishing to express an opinion on the matters to be considered at the public hearings will be heard orally or in writing.

ORDINANCE NO. 229
The following is a summary of the City of Avon, Zoning Ordinance amendment which was adopted on March 7, 2022, by the City Council, of the City of Avon, Stearns County, Minnesota.
Amend Chapter 10 C-2 Highway Commercial Business District, Subd. 5, Interim Uses, A. to include:
2. Motor vehicle and truck fuel sales, motor vehicle and recreational vehicle repair and service, major automotive repair, motor vehicle, farm implement and recreation equipment sales, uses, structures, and outdoor sales and storage accessory thereto provided that:
a. Motor fuel facilities are installed in accordance with state and city standards.
b. Adequate space shall be provided to access gas pumps and allow maneuverability around the pumps. Underground fuel storage tanks are to be positioned to allow adequate access by motor fuel transports and unloading operations minimize conflict with circulation, access and other activities on the site.
c. Wherever fuel pumps are to be installed, pump islands shall be installed.
d. A protective canopy located over the pump island(s) may be an accessory structure on the property; however, adequate visibility both on and off site shall be maintained.
e. An internal site pedestrian circulation system shall be defined and appropriate provisions made to protect such areas from encroachments by parked cars or moving vehicles.
f. When abutting a residential use in a residential use district, the property is adequately screened and landscaped.
g. Parking areas shall be screened from the view of abutting residential districts.
h. Vehicular access points shall be limited, shall create minimal conflict with through traffic movements, shall comply with all appropriate Chapters of this Ordinance as may be amended and shall be subject to the approval of the City Engineer.
i. Provisions are made to control and reduce noise.
j. The entire site other than that taken up by a building, structure or plantings shall be surfaced so as to control dust subject to the approval of the City Engineer.
k. The entire area shall have a drainage system subject to the approval of the City Engineer.
l. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot.
m. Parking, lighting, signage, etc. are in compliance with appropriate Chapters of the Ordinance as may be amended.

Chair Heller called the meeting to order at 6:30 pm. The Pledge of Allegiance was recited. The following members were present: Mr. Heller, Mr. Heidgerken, Mr. Dufner, Mrs. Uphoff, Mrs. Feldewerd, Mrs. Klassen, & Mr. Klasen. SUMMARY OF ORDINANCE NO. 227
The following is a summary of the City of Avon, amendment to the Zoning Ordinance which was adopted on May 2, 2022 to include Chapter 21, General District Provisions, Subd. 12.
Alternative Energy Systems
Ground Source Heat Pump Systems, Wind Energy Systems, and Solar Energy Systems.
A) The purpose of this chapter is to accommodate alternative energy sources by removing regulatory barriers and creating a clear regulatory path for approving alternative energy systems.
B) Create a livable community where development incorporates sustainable design elements such as resource and energy conservation and use of renewable energy.
C) Protect and enhance air quality and decrease use of fossil fuels.
D) Accommodate alternative energy development in locations where the technology is viable and environmental, economic and social impacts can be mitigated.

Notice is hereby given that the Stearns County Planning Commission, in and for the County of Stearns, will conduct certain public hearings as follows:
To consider an Interim Use Permit application submitted by Knife River Corp – NC, Sauk Rapids MN on behalf of Glen Hinnenkamp, Melrose MN according to Sections 4.18, 6.17, 7.17 and 9.2.6 B and E of Stearns County Land Use and Zoning Ordinance #439 to operate a temporary asphalt mixing facility and mining operation on approximately 39.2 acres in the Agricultural 80 (A-80) zoning district. The property is in part of the W1/2 SW1/4 and part of the NE1/4 SW1/4 in Section 30, Melrose Township (126/32). The property lies north of 390th St and east of County Rd 168. The property address is 31484 390th St, Melrose MN.
