Special Board Meeting Minutes

August 24, 2022

5:00pm; Virtual via Google Meet

Board Chair Winkels called the meeting to order at 5:00p.m. Board members Utsch, Hess and Uphoff were in attendance as well as Superintendents Bullard, Winter, Peschel and Okerlund; Director Fevig, Business Manager Raiter, and legal counsel Liz Vieira. 

There were no additions or changes to the agenda; no motion needed.

Chair Winkels called for a motion to close the meeting for the purpose of negotiation strategies pursuant to MN Statute 13D.03.  Utsch moved, Uphoff seconded, motion carried unopposed.

Utsch moved to reopen the meeting after the discussion on negotiation strategies were complete. Hess seconded, motion carried unopposed. 

Winkels adjourned the meeting at 5:43pm.

Proposed Property Taxes

City of Albany

The Albany City Council will hold a public hearing at 6:30 PM or as soon as thereafter on Wednesday, December 7, 2022, at the Albany City Hall, 400 Railroad Avenue, Albany, MN 56307 to consider approving the 2022 budget and the amount of property taxes it is proposing to collect to pay for the costs of services the City will provide in 2023.

NOTICE OF APPLICATION FOR A

LIVESTOCK FEEDLOT PERMIT

Notice is hereby given per Minnesota Statues, Chapter 116, that Evergreen Acres Estates- Silver’s Dairy has made application to the Minnesota Pollution Control Agency and/or Stearns County for a permit to construct or expand a feedlot with the capacity of 500 animal units or more.

The existing feedlot is located in the SW ¼ of the NW ¼  (T124, R31) of Section 20 of Farming Township, Stearns County, Minnesota. The existing facility consists of a 95X150’ Total Confinement Barn, a 6,297ft2 Total Confinement Barn, a 42x70 Parlor (Total Confinement Building), 600 Calf Hutches (6’ diameter poly dome), a 102x 382 Total Confinement Barn and a 42x70 Bedding Shed (Building for Animal Husbandry) and a 30x85 Breezeway (Total Confinement Barn). Manure is stored in a 150x170x12’ earthen basin (LMSA) and a 9x12x8’ concrete pump out and a short-term stockpile. The facility consists of 450 Dairy Cows (1,000 lbs or more), 10 Dairy Heifers and 600 calves for a total of 757 animal units. 

The proposed facility will include the above listed feedlot animal holding areas with the expansion of the liquid manure storage (LMSA) to a 230x550x18’ earthen basin and the addition of a 60x100x8’ stacking slab (Permanent Manure Stockpile Pad). There will be 627 Dairy Cows (1000 lbs or more) and 600 Calves. Total animal units will be 997.8

This publication shall constitute as notice to each resident and each owner of real property within 5,000 feet of the perimeter of the proposed feedlot as required by Minnesota State Law.

Board Meeting Minutes

July 11, 2022

6:30pm; Virtual via Google Meet

Board Chair Winkels called the meeting to order at 6:30p.m. Board members Utsch and Uphoff were in attendance as well as Superintendents Bullard, Winter, and Okerlund; Director Fevig, Coordinator Dierks and Administrator Hoffarth. Board member Hess and Superintendent Peschel were absent. 1 WCED visitor was present.

There were no additions or changes to the agenda; no motion was needed. 

After a review of consent agenda items, Utsch moved, Uphoff seconded approval of the June 23, 2022 Board Minutes; bills payable #23963-23994 along with 22-23 1 year lease agreements for Beacon, ALC and WCED office space. Motion carried unopposed via roll call.

Under new business, 13 policies and 2 forms were presented for the first read.  All are MSBA policies with non-substantive changes.   Next, the board heard updates for the ALC and Beacon student handbooks.  Uphoff motioned, Utsch seconded accepting the updates as presented. Motion carried unopposed via roll call.   Next the board was presented with the annual designation for Director Fevig as the Identified Official with Authority (IOwA) for MDE access.  Uphoff motioned, Utsch seconded for Fevig to continue as the IOwA. Motion carried unopposed via roll call. 

Winkels adjourned the meeting at 6:46pm.

NOTICE OF PUBLIC HEARING

ON PROPOSED ASSESSMENT FOR

WHISPERING OAKS AT TWO RIVER

(Forfeited property sold-assessment)

NOTICE IS HEREBY GIVEN that the Albany City Council will hold a public hearing at 6:30 PM or as soon as possible on Wednesday, December 7, 2022, in the Council Room at 400 Railroad Avenue, Albany, MN to consider and possibly adopt the proposed assessment for single-family residential lot, forfeited property that has been sold, within the Whispering Oaks at Two River for costs related to the installation of utilities, streets and other municipal improvements. Adoption by the City Council of the proposed assessment may occur at the hearing.

Written or oral objections will be considered at the hearing, but the Council may consider any objections to the amount of the proposed individual assessment at an adjourned meeting upon such further notice to the affected property owner as it deems advisable. 

Such assessment is proposed to be payable in one (1) installment. You may pay the entire assessment (total) on such property to the City of Albany on or before December 1, 2022.  If not paid by this date, the remaining delinquent amount shall be payable in full with general taxes for the year 2023. The remaining balance shall be payable in equal annual installments including principal and interest extending over a period of seven (7) years, with interest at the rate of 4.0% per annum, in the amount annually required to pay the principal over such period at such rate, the first of said installments to be payable with general taxes for the year 2023, collectible with such taxes during the year 2023.  You may at any time thereafter pay to the Stearns County Auditor-Treasurer the entire amount of the assessment. 

An owner may appeal an assessment to District Court pursuant to Minnesota Statutes Sections 429.081 by serving notice of the appeal upon the Mayor or City Administrator of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or City Administrator. 

No such appeal as to the amount of an assessment as to a specific parcel of land may be made unless the owner has either filed a signed written objection to the assessment with the City Administrator prior to hearing or has presented the written objection to the presiding officer at the hearing.
